Reporting Errors

California residents have rights under the California Consumer Credit Reporting Agencies Act and under the federal Fair Credit Reporting Act to have credit reporting errors fixed.

Errors on your credit report can prevent you from receiving a loan, force you to borrow at a higher interest rate than necessary, or even affect your employment opportunities.

If you have noticed any of the following errors on your credit reports, call the Law Office of James Michel at 415-239-4949 and we can help you report the dispute with the proper agency or department.

  • A delinquency is still being reported more than 7.5 years after it occurred.
  • Account shows an incorrect delinquency date.
  • Account that was discharged in bankruptcy is being reported as “unknown” or still in collection.
  • Account that you closed does not indicate that it was “closed by consumer.”
  • A car loan is listed as a “repossession” when you returned the car yourself.
  • Account history is incorrect.
  • You do not recognize an account or entry.
  • Someone’s else’s account information is being listed on your credit report, also known as a “mixed file.”
  • Account is being listed without showing that you have disputed the debt.
  • Account info does not show that debt was “charged off.”
  • Child support payments are listed which are more than 7 years overdue.
  • Any errors which were caused by identity theft (see below).
  • Repeated credit pulls from an account that was discharged in bankruptcy.

Identity Theft

You DO NOT have to be responsible for debts or credit reporting errors due to identity theft if you take prompt action.

If you suspect you are a victim of identity theft, the Law Office of James Michel can help you:

• report your specific disputed debts and credit report entries to law enforcement.
• enforce your right to have that theft properly noted on your credit reports.

Note that to make a claim of identity theft, you are not required to prove who stole your identity.
